CUSTOM IMAGE UPLOAD POLICY
Effective Date: May 2026
By uploading an image to BurrowSwap for a custom 3D model, personalised product or likeness-based creation, you confirm and agree to the following terms.
- Minimum Age Requirement
You must be at least 18 years old to place a custom image order through BurrowSwap.
- Legal Rights And Permission To Use Images
By uploading an image, you confirm that you:
• own the image
• took the image yourself
• or have full legal permission and authority from the copyright holder and any person shown in the image to use it for custom product creation
You confirm that the upload and use of the image does not infringe any copyright, intellectual property rights, privacy rights, publicity rights or other rights belonging to any third party.
- Permission From People Shown In Images
If the uploaded image contains another person, including family members, friends, partners or any other identifiable individual, you confirm that you have their full knowledge, consent and permission to use their likeness for custom product creation.
- Images Of Children
If the uploaded image contains a child under the age of 18, you confirm that you are:
• the child’s parent or legal guardian
• or have clear permission from the child’s parent or legal guardian to upload and use the image
BurrowSwap reserves the right to refuse any image involving a child where concerns arise regarding safeguarding, privacy, consent, suitability or the nature of the request.
- Prohibited Content
BurrowSwap will not accept or process images that are, or appear to be:
• unlawful or illegal
• stolen or uploaded without permission
• copyrighted or protected without appropriate authorisation
• celebrity or public figure images used without permission
• intended to impersonate, harass, threaten or embarrass another person
• misleading, manipulated or AI-generated to imitate another person without consent
• explicit, sexual, indecent or inappropriate
• hateful, discriminatory, abusive or offensive
• exploitative, unsafe or inappropriate involving children
• likely to breach another person’s privacy, consent or legal rights
• otherwise unsuitable for production at BurrowSwap’s discretion
- Right To Refuse Or Cancel Orders
BurrowSwap reserves the right to refuse, cancel or remove any order at any stage where concerns arise relating to:
• copyright
• consent
• safeguarding
• privacy
• impersonation
• legality
• misuse
• suitability
• fraud
• or any other legitimate business or legal concern
BurrowSwap also reserves the right to refuse any image or order without providing a detailed explanation where necessary to protect safeguarding, privacy, legal or business interests.
- Verification Requests
Where necessary, BurrowSwap reserves the right to request additional verification or confirmation before proceeding with a custom order.
This may include requesting:
• additional information
• written confirmation of consent
• proof of authority
• or a brief identity verification process
Such requests are intended solely to assist in assessing whether appropriate rights, permissions or consent appear to exist.
Failure to provide requested verification may result in the order being delayed, refused or cancelled.
BurrowSwap is not responsible for independently verifying ownership, identity, consent or legal rights relating to uploaded content unless otherwise required by law.
- Customer Responsibility
Customers accept full responsibility for all uploaded content and confirm that all required permissions, rights and consents have been obtained before placing an order.
Customers agree not to upload false, misleading, fraudulent or impersonating content.
Any attempt to falsely claim ownership, identity, authority or consent relating to an uploaded image may result in immediate order cancellation.
BurrowSwap reserves the right to retain records where legally necessary and to cooperate with relevant legal authorities or processes where unlawful activity or misuse is suspected.
- Customer Warranty
By placing an order, customers warrant that:
• they possess all necessary legal rights and permissions relating to uploaded images
• the uploaded content complies with all applicable laws and regulations
• the upload and use of the image does not infringe the rights, privacy or consent of any third party
Customers accept full legal responsibility for the content they upload.
- Customer Indemnity
Customers agree to indemnify and hold harmless BurrowSwap against any claims, complaints, disputes, damages, liabilities, losses, costs or legal expenses arising from:
• uploaded images
• copyright disputes
• consent disputes
• misuse of likeness
• impersonation
• privacy claims
• or misuse of the service
- Artistic Interpretation
Custom products created by BurrowSwap are artistic 3D interpretations based on supplied images.
Final products may vary in appearance, detail, proportion, texture, colour, facial features, expression or likeness from the original uploaded image.
BurrowSwap does not guarantee an exact replication of any person, image or feature.
- Image Quality
Customers are responsible for providing clear, suitable and high-quality images for production.
BurrowSwap cannot guarantee successful results from images that are:
• blurry
• low resolution
• heavily filtered
• obstructed
• poorly lit
• altered
• unsuitable for production
- Refunds And Cancellations
Due to the personalised nature of custom products, orders may not be cancelled, returned or refunded once production has started, except where required by applicable law or where a product is faulty.
If an uploaded image is refused before production begins, customers may be offered the opportunity to provide a replacement image or receive a refund.
- Use Of Uploaded Images
Uploaded images will only be used for the purpose of creating the requested custom product unless separate explicit permission is provided by the customer for marketing, promotional or social media use.
BurrowSwap will not sell, publicly distribute or intentionally share uploaded customer images with third parties except where required by law.
- Storage And Deletion
Uploaded images may be stored temporarily while orders are being processed.
Images may be retained for customer support, dispute resolution, legal obligations or agreed future reproductions where necessary.
BurrowSwap may delete uploaded images after order completion at its discretion.
- Data Protection And Privacy
Uploaded images may contain personal data.
BurrowSwap processes customer images solely for the purpose of fulfilling custom orders and in accordance with applicable UK data protection laws, including the UK GDPR and Data Protection Act 2018.

- Chargebacks And Disputes
Where customers confirm they possess the necessary rights and permissions relating to uploaded images, BurrowSwap reserves the right to provide evidence of policy acceptance, customer confirmations and uploaded order information in response to:
• payment disputes
• chargebacks
• copyright complaints
• legal claims
• or fraud investigations
- Production Delays
Orders may be delayed where uploaded images require additional review for:
• quality
• consent
• safeguarding
• suitability
• verification
• or legal concerns
- Limitation Of Liability
BurrowSwap shall not be liable for any indirect, incidental, consequential or special loss arising from:
• uploaded images
• customer misuse
• likeness disputes
• production outcomes
• delays
• or the use of personalised products
Nothing within this policy excludes liability where exclusion is not permitted under applicable law.
- Governing Law
This policy shall be governed by and interpreted in accordance with the laws of England and Wales.

By uploading an image and placing an order, you confirm that:
• you have read and understood this policy
• you possess all necessary permissions and consents
• you accept full responsibility for uploaded content
• you understand custom products are artistic interpretations
• and you agree to these terms in full
